Terms of Service

1. Acceptance of Terms

By accessing or using SnifoxAI Gateway ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Service Description

SnifoxAI Gateway is a PaaS AI Gateway platform that provides unified API access to multiple AI models from various providers. The Service offers:

• Access to multiple AI models through a single API endpoint
• OpenAI-compatible API format
• Two pricing models: Pay As You Go (PAYG) and Quantum subscription
• Credit-based billing in USD with fixed exchange rate of $1 = Rp 11,000
• API key management and usage tracking

3. Account Registration and Access

3.1. Account Creation: User accounts are created by platform administrators only. There is no public self-registration.

3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and API keys. Notify us immediately of any unauthorized access.

3.3. Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior. Accounts that breach the prohibited-content rules in Section 5.2 are suspended automatically under Section 5.4, without warning and without refund.

4. Payment and Billing

4.1. PAYG Model: Prepaid credit balance deducted per request based on model token usage. Minimum top-up: $1 (Rp 11,000). Credit expires 1 month from top-up date.

4.2. Quantum Subscription: Fixed monthly fee for daily token quota. Unused daily tokens do not roll over. Subscription expires 1 month from activation date.

4.3. Exchange Rate: The fixed rate of $1 = Rp 11,000 applies to all transactions and may be updated with prior notice.

4.4. Payment Confirmation: Payments are processed manually by administrators within 1-5 minutes during business hours.

4.5. Refunds: Credit top-ups and subscriptions are generally non-refundable except in cases of service failure or billing errors at our sole discretion.

5. Acceptable Use Policy

5.1. Fair and Lawful Use:You must use the Service reasonably, in good faith, and in compliance with all applicable laws of the Republic of Indonesia and of any jurisdiction you operate in. "Reasonable use" means using the API for its intended purpose — building and running your own applications — at a volume consistent with your plan.

5.2. Prohibited Content: You may not send prompts to, or attempt to generate content through, the Service that involves:

• Criminal activity — planning, facilitating, or instructing on theft, trafficking, terrorism, weapons or explosives manufacture, drug synthesis, money laundering, or any other offence
• Child sexual abuse material (CSAM) — any sexual content involving minors, in any form, real or synthetic. This is reported to the authorities, not merely blocked
• Sexual content — pornographic or sexually explicit material, and any non-consensual sexual content including deepfake intimate imagery
• Abuse and harassment — threats, intimidation, stalking, doxxing, bullying, or targeted campaigns against an individual or group
• Hate speech — content attacking or dehumanising people on the basis of religion, ethnicity, race, nationality, gender, disability, or sexual orientation
• Violence and self-harm — glorification or incitement of violence, and content encouraging suicide, self-injury, or eating disorders
• Malware and intrusion — writing viruses, ransomware, exploits, phishing kits, or tooling intended to compromise systems you are not authorised to test
• Fraud and deception — scams, phishing text, fake identities, forged documents, fake reviews, or impersonation of a real person or organisation
• Disinformation — content designed to manipulate elections, spread false medical or legal advice as authoritative, or deceive at scale
• Privacy and IP violations — processing other people's personal data without a lawful basis, or reproducing copyrighted works to evade licensing

5.3. Prohibited Technical Conduct: Regardless of content, you may not:

• Circumvent rate limits, quotas, billing, or credit deduction by any means
• Share, sell, sublicense, or resell your API key or plan access without written permission
• Operate a competing gateway, proxy, or reseller service on top of ours
• Run load tests, denial-of-service traffic, or automated scraping that degrades the platform for others
• Reverse engineer, decompile, or probe the platform outside a written security-testing agreement
• Create multiple accounts to evade a suspension, a quota, or a free-tier limit

5.5. Enforcement and Detection: Because we do not store your prompts (see our Privacy Policy), enforcement is triggered by upstream provider abuse reports, safety signals returned with a request, anomalous usage patterns, and reports from third parties. You remain fully responsible for what you send, whether or not we observe it.

5.6. Rate Limits: PAYG models have no platform-imposed RPM limits but are subject to upstream provider limits. Quantum plans have defined RPM limits per plan tier.

5.7. Data Handling: We log token counts and request metadata for billing and diagnostics. We do not store your prompts or the model's responses, and we do not train models on your data. See the Privacy Policy for the full picture.

6. Service Availability and Support

6.1. Uptime: We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

6.2. Model Availability: AI model availability depends on upstream providers. We may add or remove models at any time with reasonable notice.

6.3. Support: Support is provided via WhatsApp during Indonesian business hours (GMT+7).

7. Intellectual Property

7.1. Platform IP: SnifoxAI Gateway, its code, design, and documentation are proprietary and protected by intellectual property laws.

7.2. User Content: You retain ownership of content you submit to the Service. You grant us a limited license to process your requests.

7.3. AI-Generated Content:Ownership and usage rights of AI-generated content are governed by the respective upstream provider's terms.

8. Limitation of Liability

To the maximum extent permitted by law, SnifoxAI Gateway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 3 months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless SnifoxAI Gateway, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

10. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. In summary: we meter input and output tokens for billing, and we do not store your prompts or the model's responses.

We implement reasonable security measures to protect your data, but cannot guarantee absolute security of data transmission over the internet.

11. Governing Law and Dispute Resolution

11.1. Governing Law: These Terms are governed by the laws of the Republic of Indonesia.

11.2. Dispute Resolution: Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of Jakarta, Indonesia.
